1. Extent of Contract
All quotations are made and all orders are accepted only upon and subject to these Conditions of Sale. Unless expressly accepted in writing by Martin Kittsteiner - in the following M.K. -, no variation of these conditions however made by you will have any effect.
2. Order Acceptance Policy
Your online order is an offer for M.K.: You will receive a confirmation of this order immediately by email. This receipt of an order confirmation does not signify M.K.`s acceptance of your order, nor does it constitute confirmation of M.K.`s offer to sell. It just informs you about the online order. Not until you have received the mail-order confirmation from M.K. your offer is accepted. You will receive this confirmation not later than the day delivery starts.
3. Cancellation of an order
A Cancellation has to be made in writing, for example as email or by returning the good. This has to be done within two weeks after receiving the good. In case that the order amount is more then 40 Euros, M.K. pays for the return, except the sender lives abroad. If the good is damaged by You, M.K. is allowed to charge this loss in value.
4. Delivery
M.K. delivers to the address which is quoted by you. All despatch dates quoted are estimated, are not guaranteed and do not form a term of this contract. M.K. is allowed to resign when he is not delivered by the manufacturer of the products. In this case M.K. will inform you as soon as possible. Payments will be returned.
5. Payment
The only accepted payment is payment in advance.
6. Exchange / Refund
Any Exchange is based upon the general exchange regulations in Germany.
7. place of fulfilment
Place of fulfilment is Hamburg, Germany.
8. Applicable law
It applies German right with exclusion of the UN Convention on Contracts for the International Sale of Goods. If you are without a place of general jurisdiction in Germany, the mutually agreed place of jurisdiction is Hamburg, Germany.
